India PMO Officials Hid 2G Facts From Manmohan Singh, Says Court

Senior authorities at the workplace of then head of the state Manmohan Singh had "stifled the most pertinent and dubious part" of A Raja's letter and the then telecom serve "can't be blamed" for distorting current realities, an exceptional court said on Thursday.

The CBI had affirmed that Mr Raja had deceived Dr Singh in his letters on a few central points of interest connected with the strategy of award of 2G range licenses, including first-start things out served and the cut-off date.

"It was anything but A Raja, yet Pulok Chatterjee, in interview with T K A Nair, as he had smothered the most applicable and dubious piece of the letter of A Raja from the then Prime Minister," Special CBI Judge OP Saini said while absolving all denounced in three separate 2G range cases.

"Eventually, I observe no legitimacy in accommodation of the arraignment that the Prime Minister was either deluded by A Raja or that the realities were distorted to him," the adjudicator said while offering a stinging comments against the top officials.

Judge Saini said that CBI's contentions in such manner were progressed just to "bias" the brain of the court. "The contentions have been taken up by the arraignment just to bias the brain of court by summoning the high name and authority of Prime Minister of the country," he said.

The court held that Mr Raja "can't be blamed" for supposed deception of realities before Dr Singh as the total realities were not put before him by his own office.

Alluding to a note by Mr Chatterjee, the court said it was lengthier than Mr Raja's letter to the state head.

"Head of the state is a bustling leader. Wherefrom would he carve out opportunity to peruse such extended notes. Head of the state isn't supposed to be inundated in documents. It was a lot more straightforward and better for him to peruse and comprehend the letter of A Raja as opposed to this note of Pulok Chatterjee," it said.

Mr Raja had composed letters to Dr Singh illuminating him regarding the choices of the Department of Telecom (DoT) on a few issues, including giving letter of purposes for new licenses and handling of huge number of utilizations following insufficient range.

Alluding to Mr Chatterjee's note, the court said that it examined just the range related issues and didn't at all consider the issue of new licenses, which were to be given according to the changed standards from the date of use to the date of installment and was additionally the most dubious one.

It said that it was not satisfactory from the record regardless of whether the note was seen by the then state leader.

"In any case, obviously someone from the PMO had tried out ahead to the DoT for issue of new licenses and most likely it was Pulok Chatterjee himself, as his note records that he had addressed Secretary (T)," the court said. The extraordinary appointed authority further said that main a fractional view was set before the then state head with respect to range related issues by the PMO.

"Likewise, DoT gave 120 LOIs on January 10, 2008. Accordingly, the record shows that the realities were distorted to the then Prime Minister by the authorities of the PMO and not by A Raja," it said.

The court additionally managed the CBI's claims that Mr Raja had deceived Dr Singh on the issue of assessment of the law service to allude the issue to the Empowered Group of Ministers (EGoM). "The activity of DoT shows that the assessment of Law Minister was thought of as inappropriately after due consultation in the DoT and the equipped position to comprise Group of Ministers, that is to say, Prime Minister was appropriately educated," it said.

The adjudicator noticed that without a trace of legitimately acceptable proof, the CBI was attempting to demonstrate its case only by contentions across the bar, which was not a right methodology, as their entries depended on guesses and hypotheses alone.
